NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF GLYNN Under and by virtue of the power of sale (the ower of Sale contained in that certain Deed with Power of Sale to Secure Debt (the ecurity Deed given by Linda Ganas Mitchell to Security Bank of Bibb County, dated March 3, 2005, recorded in Deed Book 1620, Page 486; modified May 4, 2011 and recorded in Deed Book 2878, Page 307; modified August 4, 2011 and recorded in Deed Book 2901, Page 273, said Clerk Office as assigned by the Federal Deposit Insurance Corporation as receiver for Security Bank of Bibb County to State Bank and Trust Company by Assignment of Loan Documents, dated April 19, 2012, recorded in Deed Book 2991, Page 298, Clerk Office, Glynn County Superior Court conveying the after-described property through the open-end provisions therein, to secure that certain note from Linda Ganas Mitchell to Security Bank of Bibb County, dated March 3, 2005 (the ote in the original principal amount of Three Hundred, Eighty-Four Thousand, Three Hundred, Sixty-One and no/100 Dollars ($384,361.00), with interest thereon as set forth therein. There will be a sale at public outcry to the highest bidder for cash before the courthouse door of Glynn County, Georgia, within the legal hours of sale on the first Tuesday of August, 2012, the following described property (the roperty : All that certain tract, parcel or lot of land, containing 1.120 acres, situate, lying and being in the 26th District G.M., Glynn County, Georgia, located, designated and shown upon a map and plan of Key Industrial Park, Section 2, prepared by John H. Ringeling, Registered Engineer No. 751, dated June 21, 1973, as TRACT NUMBER 20 OF PHASE 2, containing 1.120 acres and being more particularly located and described according to a plat of survey made by Bilotzskov & Associates, Inc., dated May 26, 1977, attached to that certain deed of conveyance from Elliott Robinson and Persons Brothers Company to the Grantor herein, dated June 17, 1977, reference being hereby made to said plat for all purposes as follows, to wit: COMMENCING at the point of intersection of the easterly line of New Community Road with the southerly line of Key Circle, thence from said beginning point running north 73 degrees 48 minutes east for a distance of 190.05 feet to a corner marked by an iron pin; thence turning and running south 36 degrees 56 minutes east for a distance of 294.03 feet to a corner marked by an iron pin on the northerly line of Tract Number 21 of Key Industrial Park; thence turning and running south 73 degrees 48 minutes west along the said northerly line of Tract Number 21 of Key Industrial Park for a distance of 165 feet to a corner marked by an iron pin on the easterly line of New Community Road; thence running north 41 degrees 21 minutes west along the said easterly line of New Community Road for a distance of 303.80 feet to a corner marked by an iron pin at the point or place of beginning as aforesaid. The debts secured by said Security Deed have been and are hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Notes and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying same and, additionally, all expenses of this sale, as provided in the Security Deed and by law, including without limitation attorney fees (the statutory notice of intent to collect attorney fees having been served). Said Property will be sold subject to any outstanding ad valorem taxes (including taxes that are a lien, but not yet due and payable); matters that may be disclosed by an accurate survey and/or inspection of the property; assessments, liens, encumbrances, zoning ordinances, restrictions, covenants; and matters of record superior to the Security Deed. Additionally, this sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) final confirmation and audit of the status of the loans with the holder of the Security Deed.
