NOTICE OF SALE UNDER POWER GEORGIA, COLUMBIA COUNTY Under and by virtue of the Power of Sale contained in a Security Deed from PAMELA HUGHES and ROBERT C. HUGHES to AAA MORTGAGE & FINANCIAL CORPORATION, dated OCTOBER 28, 1996, and recorded on NOVEMBER 18, 1996, in DEED BOOK 1776, PAGES 332-338, of the COLUMBIA County, Georgia Records; as last transferred and assigned to BANKERS TRUST COMPANY OF CALIFORNIA, N.A. N/K/A DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE ON BEHALF OF UCFC MH TRUST 1996-2, by GREEN TREE SERVICING LLC, pursuant to an assignment of mortgage recorded FEBRUARY 24, 1998, in BOOK 1978, PAGE 30, aforesaid records; conveying the after-described property to secure a Note in the original principal amount of SIXTY-FOUR THOUSAND Dollars and 00/100 ($64,000.00) with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of COLUMBIA County, Georgia, within the legal hours of sale on the first TUESDAY in JUNE, 2012, the following described property: All that lot, tract of parcel of land, together with improvements thereon, situate, lying and being in the County of Columbia, State of Georgia, said tract being known and designated as Tract #2 on a plat of Wahl Estates Subdivision made by Ayer, Baker, Graham and Associates, Inc., for Pollatty Realty Company dated September 1976, and being recorded in the Office of the Clerk of Superior Court of Columbia County, Georgia, in Plat Cabinet AA, Slide 28, No. 10. Said tract consists of 3.33 acres and is bounded; On the North by Lanatte Lane, said plat; On the South by property now or formerly of Pierce Anderson, said plat; On the East by Lot #3, said plat; on the West by Lot #1, said plat. Said plat is incorporated herein by reference for a more complete and accurate description of the metes, bounds and location of said property and for easements and building lines shown thereon. MOBILE/MANUFACTURED HOME DESCRIPTION; 1995 BELCREST 17396 A & B 70 X 28. Borrower, being the true and lawful owner of record of the mobile home being mortgage with the property declares that it is Borrower's intent that the mobile home lose its nature as personality and become realty. Borrower further declares that the mobile home shall remain permanently attached as a part of the real property and will not be removed therefrom. The indebtedness secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, non-payment of the monthly installments as required by said Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given) and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
