OCONEE COUNTY



Pursuant to the Power of Sale contained in a

Security Deed given by Charles Mitchum Van-

derford and Ginger Leigh Vanderford to Wells

Fargo Home Mortgage, Inc. dated 12/30/2003

and recorded in Deed Book 722 Page 629,

Oconee County, Georgia records; as last trans-

ferred to Bank of America, National Associa-

tion by Assignment filed for record in Oconee

County, Georgia records, conveying the

after-described property to secure a Note in the

original principal amount of $ 560,000.00, with

interest at the rate specified therein, there will

be sold by the undersigned at public outcry to

the highest bidder for cash before the Court-

house door of Oconee County, Georgia, within

the legal hours of sale on the first Tuesday in

July, 2011 (July 05, 2011), the following de-

scribed property:



All that tract or parcel of land, together with all

improvements thereon, situate, lying and being

in the 224th GMD, Oconee County, Georgia,

containing 5.000 acres, more or less, being

known and designated as Tract No. 2, 5.000

acres, and being more particularly described

according to a plat of survey entitled "Survey

for Administrative Subdivision Plat Charles

Vanderford and Ginger Vanderford" prepared

by Borders and Associates, certified by Paul E.

Borders, RLS, dated January 29, 2002, revised

March 28, 2003, recorded in Plat Book 34,

page 186, Oconee County records and incorpo-

rated herein; being a portion of the property

conveyed by deed recorded in Deed Book 582,

page 35, said records.

TOGETHER WITH rights of access, ingress

and egress, including the right to place utilities,

over and across the 25 foot ingress-egress

easement along existing gravel drive shown on

the above referenced plat and running from He-

bron Church Road in a generally southeasterly

and southerly direction to the above property.



The debt secured by said Security Deed has

been and is hereby declared due because of,

among other possible events of default, failure

to pay the indebtedness as and when due and

in the manner provided in the Note and Secu-

rity Deed. The debt remaining in default, this

sale will be made for the purpose of paying the

same and all expenses of this sale, as provided

in the Security Deed and by law, including at-

torney s fees (notice of intent to collect attor-

ney s fees having been given).



Said property is commonly known as 1181 He-

bron Church Road, Statham, GA 30666 to-

gether with all fixtures and personal property at-

tached to and constituting a part of said prop-

erty, if any. To the best knowledge and belief of

the undersigned, the party (or parties) in pos-

session of the subject property is (are): Ginger

Leigh Vanderford and Charles Mitchum Van-

derford or tenant or tenants.



Said property will be sold subject to: (a) any

outstanding ad valorem taxes (including taxes

which are a lien, but not yet due and payable),

(b) the right of redemption of any taxing author-

ity, (c) any matters which might be disclosed by

an accurate survey and inspection of the prop-

erty, and (d) any assessments, liens, encum-

brances, zoning ordinances, restrictions, cove-

nants, and matters of record superior to the Se-

curity Deed first set out above.



The sale will be conducted subject to (1) confir-

mation that the sale is not prohibited under the

U.S. Bankruptcy Code; and (2) final confirma-

tion and audit of the status of the loan with the

holder of the Security Deed. Pursuant to

O.C.G.A. Section 9-13-172.1, which allows for

certain procedures regarding the rescission of

judicial and non-judicial sales in the State of

Georgia, the Deed Under Power and other fore-

closure documents may not be provided until fi-

nal confirmation and audit of the status of the

loan as provided immediately above.
